The following describes the use of your personal data and your rights under the existing data protection legislation – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27th April 2016, on the protection of natural persons with regard to the processing of personal data, and Organic Law 3/2018, of 5th December, on the Protection of Personal Data and Guarantee of Digital Rights, henceforth, the “applicable legislation on data protection”.

2.     For what purpose(s) will we use your data and on what legal basis?

In accordance with the applicable legislation on data protection, your personal data will be used on a legal basis and for the purposes that we set out below:

a)     Execution or fulfilment of contractual obligations or application of pre-contractual measures

Your personal data will be used for the primary purpose of establishing, managing or finalising the contractual relation between the parties, including but not limited to the following:

·       Mooring rental and sales. Any personal information will be used that is necessary for managing the mooring rental and sales contract, as well as billing for the services rendered.

·       Billing for services rendered. Your personal data will be used to carry out the correct billing for services rendered during your stay.

·       Management of premises rental. Any personal data will be used that are necessary for managing the premises rental contract, as well as the management of payment for such services.

·       Management of dry dock and hard standing services. The information will be used that is necessary for managing access, use and billing for services in the dry dock and hard standing area.

·       Management of covered dry dock services. The information will be used that is necessary for managing staff access to boats for cleaning and maintenance.

·       Wi-Fi management. Personal data will be used to establish a connection to the Wi-Fi network.

In the event that you do not provide us with your personal data, and since they are necessary for the execution of the contract between the parties, it will not be possible to formalise the contract between the parties.

b)     Justification of a legitimate interest

When necessary, your personal data will be used to meet our own legitimate interests, as long as those legitimate interests do not take precedence over your fundamental interests, rights and freedoms. Your data will be used for the following purposes:

·       Delinquency management. Data will be used to manage outstanding customer payments.

·       Customer complaint management. Data will be used to resolve in due time and form possible incidences or complaints in services provided to customers.

·       Sending commercial communications. Your data will be used to manage the sending of commercial communications relating to products, services, promotions or any other relevant news that could be of interest to you based on legitimate interest as long as you are linked with a previously contracted service or product.

You will be able to justifiably object to this use. It should be noted that your objection to this use will not operate automatically and needs to be weighed up against the legitimate interest of the company.

c)     Consent of the interested party

Your personal data will be used, as long as you have given us your consent, for the following reasons:

·       Management of contact enquiries from interested parties. The personal information that you provided on your contact form will be used to handle your queries and to forward information that could be of interest in accordance with the request made.

·       Participation in selection processes. In the event that you have asked to participate in a selection process, your data will be used to evaluate your candidacy as a job applicant.

·       Contact enquiry management. Data will be used to manage the contact enquiries of customers that request information.

·       Refuelling of boats. Data will be used to manage the refuelling of boats and to collect data for subsequent billing.

·       Sending commercial communications. Your data will be used to manage the sending of commercial communications relating to products, services, promotions or any other relevant news that could be of interest to you.

You will be able to withdraw your consent at any time. It should be noted that the withdrawal of consent is not retroactive.

d)     Complying with a legal obligation applicable to the party responsible for using data

Your data will be used to comply with all legal obligations that are implemented, always within the framework as permitted by the different applicable legislations, for the following reasons:

·       Exercise of rights. Your data will be used to comply with the exercise of your rights established in accordance with the General Data Protection Regulation, provided that any exercise of rights request is made through the established channels.

·       Boat registration. Your personal data will be used to register boats, including those from non-member countries, which enter the port and to send information to the establishments that require it.

In this respect, in the event that you do not authorise the use of your personal data for this purpose, and since their use is necessary to comply with the legal obligations that apply to the party responsible for using data, it will not be possible to respond to your application for rights or allow your entry into the marina.

3.     Which categories of data will we use?

The possible data categories that will be used are:

a)     Execution of a contract or application of pre-contractual measures:

–      Identification data

–      Personal characteristics

–      Economic, financial and insurance data

–      Data relating to social circumstances

–      Goods and service transaction data

b)     Consent of the interested party

–      Identification data: Name, surname(s), email, telephone, gender, post code

–      Personal characteristics data: Age

–      Potentially any type of data that the interested party includes in their contact by email or chat conversation. As well as all the information that the interested party may have included in their job application and Curriculum Vitae.

c)     Legitimate interest:

–      Identification data

–      Economic, financial and insurance data

–      Other (services contracted by customers, consequences of incidents, etc.)

d)     Complying with a legal obligation applicable to the party responsible for using data:

–      Identification data

–      Personal characteristics

–      Economic, financial and insurance data

–      Potentially any type of data that the interested party includes in their exercise of rights request.

4.     Who will your data be shared with?

In order to carry out the above-described purposes, Burriananova collaborates with third-party service providers who can have access to personal data as a result of the execution of the contracted services. In any case, Burriananova follows strict selection criteria for these third parties in order to fulfil its data protection obligations and signs their corresponding data protection convention with them, where these third parties are obliged to fulfil their data protection obligations, and specifically, to deploy those legal, technical and organisational security measures which are appropriate to guarantee the security, integrity and confidentiality of the data of the interested parties, in relation to their use for the informed purposes.

Also, in the event that you give us your consent, your data may be shared with other companies in the Gimeno Group (www.grupogimeno.com) for the purpose of managing your participation in selection processes undertaken by these companies.

Your data can be shared with other companies in the business group with the aim of guaranteeing the exercise of rights by the interested party.

Personal data and any other information about the user may be disclosed if required by public authorities when exercising the duties which are legitimately attributed to them and in accordance with the provisions which may be applicable in those cases where it is deemed necessary.

Furthermore, in those cases where it is deemed necessary, if there is a legal obligation or if the employee has given their consent or if the company is authorised to do so, their data can also be shared with:

·       Public Bodies: Inland Revenue; Ministry of Land and Housing, Public Works and Structuring of the Territory – Ports, etc.

·       Maritime Health

·       Civil Guard

·       Customs

·       National Police

·       Banks for the billing of services rendered.

 

5.     How long will we keep your data?

Burriananova will comply with the existing legislation with regards to the duty of deleting personal information once the pursued aim has been reached, or even when you withdraw your consent for its use, leaving the information properly blocked, to be made available only to judges and courts, the prosecution service or the relevant public administrations for the purpose of determining any liability arising from its use, and only for the limitation period of such liabilities. At the end of these periods, that information will be removed definitively using secure methods.

6.     How have we obtained your data?

The personal data used by Burriananova are the personal data provided by you on the web contact form. Also, the information given by the interested party for the participation in selection processes, and that given for the exercise of your rights.

7.     What are your rights when we share your data?

In accordance with the provisions of the applicable legislation on data protection, as well as the national legislation on data protection, you have the right to exercise, if you so wish, the rights to access, correct and delete your data, as well as to request the limited use of your personal data, oppose the same, request the portability of your data, as well as not being the object of automated individual decisions.

Furthermore, in the event that the described use of personal data is based on consent given on your part, you can withdraw this consent at any time. In this respect, it should be noted that the withdrawal of consent will not affect the legality of the use made prior to the withdrawal of this consent.
